Families may write one check or money order to the U.S. Department of State for their passport application fees if they are applying in person at the same time. If the child is traveling with only one of their custodial parents, they must have a letter of consent, preferably in English and notarized, from the other parent or signed by both parents. The letter should say “I acknowledge that my son/daughter is traveling outside the country with with my permission.” If one parent has sole custody of the child, a copy of the custody document can take the place of the other parent’s letter. Factors Influencing the Grant of Child Custody – Having established that the primary consideration for the grant of custody of a child is the welfare and interest of that child, the next step of our inquiry is “what constitutes best interest of children which must be put into consideration by a court when making an order of custody”? There is no hard and fast rule on what constitutes best interest of a child, as this will depend largely on the circumstances of each case.
Aribi-Whyte JSC (as he then was) in the case of Williams v Williams, 14 observed as follows: “The determination of the welfare of a child is a composite of many factors. Consideration such as the emotional attachment to a particular parent, mother or father; the inadequacy of the facilities, such as educational, religious, or opportunities for proper upbringing are matters which may affect determination of who should have custody”.
It follows that where a party to a child custody proceeding can prove that it is not in the best interests of the child that custody of the child be granted to the other party, the courts will take this factor into consideration in reaching its decision.
- It is for this reason that it has been held in plethora of child custody cases that the evidence provided determines the outcome of child custody cases.
- The “best interests of the child” is the universal standard used in determining child custody disputes.
- This principle of law is statutorily provided for in section 71 of the Matrimonial Causes Act and section 69 of the Child’s Rights Act 2003,
In essence, a party seeking custody may be able to obtain custody if he/she can prove that he/she can provide sound education (emphasis being on sound ) and for the physical and mental well-being of the child. He must also to an extent prove that the other party will/may deny the child these three factors.15 The Supreme Court per Obaseki JSC (as he then was) also held in Williams v Williams, 16 that: ” It seems to me that order for custody must have in view the opportunity of sound education as well as physical and mental welfare.
The degree of familiarity of the child with each of the parents (parties); The amount of affection by the child for each of the parent and vice versa; The respective incomes of the parties; Education of the Child; The fact that one of the parties now lives with a third party as either man or woman and; The fact that in the case of children of tender ages custody should normally be awarded to the mother unless other considerations make it undesirable etc. ”
It has also become a trite principle of law that the conduct of a party claiming for custody is a major consideration. The Supreme Court per Obaseki JSC (as he then was) further held in the case of Williams v Williams, 18 ” The Welfare of an infant although the first and paramount consideration is not the sole consideration and the conduct of the parties is a matter to be taken into account.
” The above-cited authorities will strengthen the claim of a party if it can prove evidence of misconduct on the part of the opposing party. In like manner the court in Kolawole v. Kolawole 19 refused to grant custody to a mother who had once tried to kill the child. It is generally believed that girls should be in the care of their mothers whilst boys their fathers.
There is, however, no rule of law which buttresses this belief hence courts are not bound to adhere to this rule of thumb. It is believed that the best interest principle will suffice in this respect.20 In Dawodu v. Dawodu 21, the Court refused to grant custody to a mother who had no home of her own or private means to bring up the child because it was not in the best interest of the child to do so.
The important point remains that the outcome of child custody disputes largely depends on the facts of each case as well as the evidence placed before the Court. Similarly, the Courts have also pronounced on the guiding principles and considerations for a child born out of wedlock. In Muojekwu v Ejikeme, 22 the Court of Appeal provided a guiding principle on the custody of a child borne out of wedlock.
It was held in the above case that: “The Custody of any child born out of wedlock follows that of the mother in the absence of any person claiming custody of the child on the basis of being the natural father. Refer to Ben Enwonwu v Spira (supra) at p.223.
This must be so since the child must belong to a family and should not be rendered homeless for a situation he did not create.” Having established that the welfare of the child is the paramount consideration, it is important to identify the different types of custody which might be granted by the courts.
These are namely: Divided Custody; Split Custody; Joint Custody; Temporary Custody and Third-Party Custody which are all explained below.
Divided Custody – this occurs where the court directs that a child lives with each parent for different parts of the year with reciprocal visitation privileges. When this occurs, the child is expected to be in the custody of one of the parents, who will in turn exercise complete control over the child. Split Custody – this occurs when the court grants custody to one parent while care and control of the child is granted to the other, in which case the parent vested with custody has the power to control the major decisions of the child’s future while the other parent controls the day-to-day physical upbringing of the child. Joint Custody – this usually happens when the court directs both parents to share responsibility and authority with respect to the child. The effect of this is that both parents are involved in the physical sharing of custodial rights over the child as well as participating in decisions affecting the child’s life such as education, medical problems etc. This is slightly different from split custody. It should be noted that joint custody does not necessarily mean equal or fifty-fifty sharing of time since each case depends on the child’s age, parent’s availability & desires among other factors. Before an order of joint custody is made, the court must ensure that the parents would co-operate with each other, otherwise, such an order would be ineffectual.23 Temporary Custody – this occurs where custody of a child is awarded to a parent temporarily pending the outcome of a separation or divorce proceedings. This power can be exercised where during a matrimonial proceeding, a dispute with respect to the custody, guardianship, welfare, maintenance, advancement, or education of the children of the marriage arises after the proceedings for the principal relief has been instituted.24 The Petitioner or Respondent may make an application for an interim order of custody pending the final determination of the Petition. The application may be made ex-parte in cases of extreme urgency or on notice to the other party. In cases of extreme urgency, an oral application may be made subject to the leave of court before the ex-parte application or application on notice is made. Third-Party Custody – this usually happens where the court considers it desirable to do so. It may place the child under the custody of a third party- a person other than a party to the marriage, either permanently or as an interim measure if it considers this to be in the child’s interest pursuant to the provisions of section 71(3) of the Matrimonial Causes Act, This order will be made if it is either obvious that neither of the parties to the marriage is genuinely interested in the welfare and upbringing of the child or where neither of the parties to the marriage has applied for the custody or where in the opinion of the court, neither of the parties to the marriage is a fit and proper person to have the custody of the child.
However, it should be noted that it is usually in a situation where there is nothing before the court to disqualify any of the parties to the custody of the child that joint custody will be granted. In Williams v Williams 25, it was held by Obaseki JSC: “The position therefore is that there is no evidence before the Court to disqualify either parent from being awarded the custody of Kafialat Abimbola their daughter.

What is the DS 3053?
Paperwork Reduction Act – The information collection contained in this proposed rule is pursuant to the Paperwork Reduction Act, 44 U.S.C. Chapter 35, and relates to Office of Management and Budget (OMB) Control Number 1405-0129. As part of this rulemaking, the Department is seeking comment on the administrative burden associated with this collection of information.
This proposed rule will result in a change in the design of the DS-3053, the form associated with this collection of information. Department of State Form DS-3053, which is used to obtain the written consent from the parent or legal guardian of a minor passport applicant when they cannot be present at the time the application is executed, is being revised to be consistent with this rulemaking, to allow the non-applying parent or legal guardian to sign a statement of consent before a notary public or a passport specialist at one of the public passport agency/center counters located within the United States as an alternative to requiring a notarized statement when an application is pending at a passport agency/center.
OMB Control No.1405-0129, Statement of Consent: Issuance of a U.S. Passport to a Minor Under the Age 16 was last revised on December 15, 2020. The estimated burden is 20 minutes. The Department does not anticipate an increase in burden; however, in addition to comments on the proposed rule itself, the public is invited to comment on the estimated burden.

The Parent Request letter needs to include both parent’s listed on the child’s birth certificate and must include the parent’s name, date of birth, gender, their direct relationship to the child, and that they explicitly give ‘permission for the child to obtain a visa’ for the country you are traveling to.
What is special family circumstances?
Your request may qualify as a special family circumstance if the minor’s family situation makes it exceptionally difficult or impossible for one or both of the minor’s custodial parents/legal guardians to provide the notarized, written consent.

What documents are required for passport?

- In the case of a guardian, bring a guardianship certificate, issued by the court of law and the appointed Guardian will visit the Passport office personally with the minor, along with his/her original CNIC and its photocopy.

- In case of a Lost passport, bring a Lost passport Police report mentioning the previous passport number.

Are both parents required for minor passport renewal in USA?
Two Parent Consent for Minor U.S. Passports In order to issue a U.S. passport to any minor child under the age of 16 (first time or renewal), U.S. law stipulates that all parents listed on the child’s birth certificate must provide written consent. We acknowledge family situations where this may prove difficult, which is why we are sharing the following options.
- Parents who are not able to attend the appointment must submit a notarized form DS-3053 Statement of Consent.
- A copy of the same identity document used to notarize the form must be attached to the form.
- Form DS-3053 must be notarized in the United States or at a U.S.
- Embassy or Consulate.
- If a parent is in the Dominican Republic, he/she must come to the Consular Section in person to sign the passport application.
If a form DS-3053 is unable to be obtained, the applying parent must provide proof that said parent has been granted sole legal and physical custody of the child by a court order. Accepted Forms of Identification All guests will also need a form of identification to board the ship. Accepted forms of identification vary based on nationality, departure port and disembarkation port. Please note that hospital Birth Certificates (baby feet Birth Certificates), as well as photocopies or images of any required travel documents are not accepted for boarding.
U.S. Passport book that is valid at least 6 months after your cruise ends. A U.S. Passport book is required for sailings that depart from homeports outside of the U.S.
For sailings departing from U.S. homeports, an official US state-issued Birth Certificate is also accepted. Guests age 16 and older that present an official US state-issued Birth Certificate will also need to provide a valid Driver’s License or picture ID issued by the government.
U.S. citizens may use Enhanced Driver’s License (EDL) as a single form of documentation (instead of both birth certificate and picture ID) for sailings departing from U.S. homeports. Enhanced Driver’s Licenses are only available from the following states: Michigan, Minnesota, New York, Vermont and Washington State. Please note that an Enhanced Driver’s License is different from a REAL ID compliant id. An EDL will have a flag on the front.
Puerto Rican citizens should review their birth certificates and ensure they are up to date. Puerto Rican birth certificates issued prior to July 1, 2010 are not valid forms of proof of citizenship. The Government of Puerto Rico has partnered with document provider VitalChek to provide an expedited method for ordering new birth certificates. For all sailings that visit Colombia, all guests will be required to present a passport book valid for at least 6 months after the sailing’s return date in order to board. Colombian Customs and Immigration requires all visitors to have a valid passport book and will not accept any other travel documents for entry. Unfortunately, any guests without a valid passport book will be denied boarding.

For US Sailings: Non-US Citizens will require a passport valid at least 6 months after your cruise ends and the necessary visa for entry into the United States. On Transatlantic and Transpacific sailings European and Chinese guests will require ESTA (Europe) and EVUS (China). ESTAs are mandatory for everyone travelling to the US. You must apply for an ESTA no later than 72 hours before departing for the United States. Real-time approvals are not available and arriving at the airport without a previously approved ESTA will likely result in being denied boarding.
For International Sailings: Non-US Citizens will require a passport book valid at least 6 months after your cruise ends and the supporting visa for entry and exit from the country, if applicable.
For cruises departing Australia calling into only Australian ports, Australian citizens require either a valid passport or government issued pictured and laminated ID card to be used as identification. Children aged 17 years and under will require a passport or Birth Certificate to travel or government issued photo ID. Children under 16 years of age, who do not have a passport or Photo ID, must have a copy of their birth certificate or their parents Medicare Card. For all other nationalities, a passport (plus visa if needed in Australia) is required.
Europe sailings: National ID cards issued in the European Union (EU) & European Economic Area (EEA) are accepted for travel to Schengen countries only and must be valid for at least three months from the return date. Some itineraries may include a port of call outside the Schengen area. For those sailings, national ID cards will not be accepted, and passports are required for travel.
EU countries: Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.
UK citizens (including children and infants) must have their own full 10 year (5 year for children) passport with at least 3 months validity from the end of the cruise on sailings in the EU (Schengen area). On sailings leaving the EU (Schengen area): passport must be valid for 6 months after return home. EEA countries: The EEA includes EU countries and also Iceland, Liechtenstein and Norway. Switzerland is not an EU or EEA member but is part of the single market.

It is important that the name on your reservation be exactly as it is stated on your passport or other official proof of nationality. If your name has changed since your document was issued (e.g., marriage or divorce), it is required that you update the document with the new name or provide an official supporting document (e.g., a state, county or province issued marriage license, divorce decree or legal name change document) of the name change.
All documents must be the original or a notarized copy. Additionally, if you are using an identification (e.g., driver’s license) and a citizenship document (e.g., birth certificate), then BOTH documents must match the name on your reservation. Otherwise, it may result in delay or possible denial of boarding.

A traditional passport (also called a ‘passport book’) is a valid ID for all forms of travel — land, sea, and air — both internationally and domestically. A passport card can be used for international land and sea travel to select countries.
